  3. Unless explicitly stated, we do not own or develop third-party software products integrated into our solutions.

  4. CYB ENGINEER acts as a bridge between clients and developers to ensure seamless communication and performance.

3. Data Security & Liability Disclaimer

  1. The installation and configuration of software products integrated in our solutions lie with the original developer. CYB ENGINEER is here to facilitate this process under direction of the original manufacturer.

  2. However, we are not responsible for:

    • Data breaches, hacking, or unauthorized access caused by third parties or client-side negligence.

    • Loss of data, server downtime, or malware attacks.

    • Issues beyond our control, including hosting failures or third-party software vulnerabilities.

  3. Clients are responsible for maintaining strong passwords, security updates, and regular data backups.

  4. CYB ENGINEER does not access or manage client backend systems or confidential data without written authorization.

4. Support Commitment

  1. We provide implementation support, training, and post-installation guidance.

  2. Technical issues related to third-party software are escalated to the original developer when required.

  3. Our support scope does not include:

    • Client-side hardware or network failures.

    • Unauthorized software modifications.

    • Post-warranty enhancements or additional integrations (these may incur extra cost).

5. Warranty & Limitations

  1. All warranties are governed by the original developer or software provider.

  2. CYB ENGINEER does not guarantee uninterrupted service or specific outcomes, as performance depends on user operation and third-party environments.

  3. Any misuse or unauthorized customization voids all support and warranty coverage.

6. Service-Specific Terms & Conditions

A. Website & App Development

  1. Service Overview:

    • We design and develop responsive, secure, and high-performing websites and mobile applications.

    • Development includes basic SEO setup, UI/UX optimization, and device compatibility testing.

  2. Payment Policy:

    • 50% advance payment is required before the project begins.

    • The remaining 50% must be paid before the website or app goes live.

    • Delays in final payment may delay delivery or hosting activation.

  3. Client Responsibilities:

    • Provide all necessary content (text, images, videos, etc.) in a timely manner.

    • Review and approve designs during the development process.

    • Ensure timely communication for revisions or updates.

  4. Revision Policy:

    • Up to two revisions are included. Additional revisions may be billed separately.

  5. Liability Disclaimer:

    • CYB ENGINEER is not responsible for hacking, website downtime, or data loss caused by hosting providers, plugins, or third-party integrations.

    • Once the website is live, maintenance and security are the client’s responsibility unless a separate AMC (Annual Maintenance Contract) is signed.

B. Visitor Management System (VMS)

  1. Service Overview:

    • A secure, OTP-based visitor entry system replacing manual registers.

    • Includes visitor verification, live visitors data, and entry management.

  2. Payment Policy:

    • 100% advance payment before a licensed copy of software setup, activation, or delivery of credentials.                             
    • We can provide a one week free trial post demonstration.

  3. Client Responsibilities:

    • Provide accurate entry data and authorized personnel details for trial and final system setup.

    • Ensure stable internet connectivity for system operation.

  4. Liability Disclaimer:

    • CYB ENGINEER is not responsible for misuse of the system by internal staff or visitors.

    • Security and data retention policies are managed by the client’s organization.

C. HRMS & Staffing Solutions

  1. Service Overview:

    • End-to-end HR Management Software including payroll, attendance, leave, and performance tracking with geo-fencing capabilities.

  2. Payment Policy:

    • 100% advance payment is required before a licensed copy of software setup, activation, or delivery of credentials.
    • We can provide a one week free trial post demonstration.

  3. Client Responsibilities:

    • Ensure accuracy of employee data input.

    • Manage login credentials and access rights internally.

  4. Liability Disclaimer:

    • CYB ENGINEER is not responsible for salary miscalculations or incorrect data entries made by client-side users.

    • The client is responsible for adhering to applicable HR and data protection laws.

D. Asset Management System

  1. Service Overview:

    • Software to track, monitor, and manage IT and non-IT assets for better ROI and reduced downtime.

  2. Payment Policy:

    • 100% advance payment is required before a licensed copy of software setup, activation, or delivery of credentials.
    • We can provide a one week free trial post demonstration.

  3. Client Responsibilities:

    • Maintain accurate asset information and update regularly.

  4. Liability Disclaimer:

    • CYB ENGINEER is not liable for inaccurate reports or asset loss due to incorrect client data.

    • Responsibility for hardware tagging and physical verification lies with the client.

E. CRM & ERP Solutions

  1. Service Overview:

  2. Payment Policy:

    • 100% advance payment is required before a licensed copy of software setup, activation, or delivery of credentials.

  3. Client Responsibilities:

    • Review and approve workflows before deployment.

  4. Liability Disclaimer:

  3. Client Responsibilities:

  4. Performance & Disclaimer:

    • Marketing results vary depending on audience behavior, platform algorithms, and competition.

    • CYB ENGINEER does not guarantee specific leads, rankings, or conversion rates.

    • Refunds are not applicable once campaigns go live.

  5. Liability Disclaimer:

    • CYB ENGINEER is not liable for account suspension, ad rejection, or performance changes caused by third-party policies.

7. General Terms

  1. Project Timelines: Timelines depend on client responsiveness and data delivery. Delays in content or payment may extend project deadlines.

  2. Refund Policy: All advance payments are non-refundable once the project or service has started.

  3. Confidentiality: CYB ENGINEER ensures that all client information remains confidential and is used only for project execution.

  4. Force Majeure: CYB ENGINEER is not responsible for delays or failures caused by events beyond its control, including natural disasters, strikes, or internet outages.

  5. Jurisdiction: All disputes shall be governed under the laws of Ghaziabad, Uttar Pradesh (India).
